Dear President Trump,

You won the 2024 election by promising to fight for American workers. You said you’d stand up to the elites, drain the swamp, and put working people first. Now you have the chance to prove it.

The Workers’ Rapid Employee Protection Act (Workers’ REP) is the most pro-worker legislation of our lifetimes. It doesn’t create new rights—it enforces rights workers already have but can’t use. And it does so without expanding government bureaucracy or raising taxes.

This is your opportunity to cement your legacy as the president who actually delivered for workers.

FIRST: WE MUST ESCAPE THE UNION TRAP

Mr. President, for too long, America has been trapped in a false choice: union vs. non-union. This divide has been weaponized to keep workers powerless and politicians paralyzed.

Here’s what most Americans don’t know: Federal law already gives ALL workers—union or not—the right to organize, discuss wages, strike, and act collectively. These rights are outlined in Section 7 of the National Labor Relations Act. They apply to retail, warehouse, office, and gig workers. All 170 million American workers.

But the political establishment has convinced everyone this is a “union issue.”

It’s not. It’s a worker rights issue.

Mr. President, here’s what most Americans don’t understand: When two coworkers discuss their wages in a break room, that IS a union under federal law. Not a “certified union” with dues and elections and union bosses—but a legal union under Section 7 of the National Labor Relations Act. When workers band together to complain about unsafe conditions, that’s a union exercising its rights. When three restaurant workers collectively ask for better scheduling, that’s a union in action.

This happens a million times a day across America. Break room unions form spontaneously whenever workers talk about their pay, their hours, and their working conditions. Under federal law, these conversations are protected union activity.

But here’s the tragedy: These unions wither and die within hours. Not because workers don’t want to organize. Not because they don’t have legitimate grievances. But because they know that exercising their rights means getting fired, and the system won’t protect them.

The distinction that matters isn’t union vs. non-union. It’s a certified union vs. a “breakroom” union.

Certified unions—the 16 million workers in formal unions—have resources, legal teams, and institutional power to fight retaliation. When an employer fires a certified union member for protected activity, the union has the infrastructure to fight back.

Uncertified unions—the 154 million workers who form breakroom unions every single day—have nothing. When they get fired for discussing wages, they’re on their own. The legal process takes years. The penalties are meaningless. They lose their homes, their health insurance, their ability to feed their families while waiting for “justice” that arrives too late to matter.

So these unions die. The conversation in the break room stops mid-sentence. Workers silence themselves. The union that formed naturally—legally—withers under the futility of fighting a broken system.

This is the harm, Mr. President: We’re not losing 154 million potential union members. We’re killing a million actual unions that form every day and die every day because the law that protects them is not enforced.

The political establishment has spent decades hiding behind the “certified union” label. Democrats say “we support unions!” while doing nothing for the millions of breakroom unions that form and die daily. Republicans say “we won’t empower union bosses!” while ignoring that these breakroom unions have no bosses, no dues, no bureaucracy—just workers trying to exercise their legal rights.

This is the con. Frame it as a “union issue,” meaning certified unions, and politicians can avoid the real question: Why are we allowing millions of legal unions to be destroyed every day through the ever-present danger of employer retaliation?

You’re a businessman. You understand that markets only work when rules are enforced fairly. Right now, bad employers systematically destroy these breakroom unions through retaliation, knowing penalties are meaningless. Good employers who respect these legal unions face unfair competition from employers who crush them.

The Workers’ REP Act doesn’t create new unions. It doesn’t force certification. It doesn’t empower union bosses. It simply stops the daily massacre of the millions of legal unions that already exist but can’t survive because enforcement is broken.

That’s not pro-certified-union or anti-certified-union. That’s pro-law. That’s pro-market. That’s pro-fairness.

And it protects the 154 million American workers whose breakroom unions are being systematically destroyed because the law that protects them is not enforced.

When politicians hear “worker protection,” they immediately think:

  • Democrats think: “Support unions, oppose business”
  • Republicans think: “Oppose unions, support business”
  • Both are wrong.

This binary thinking is exactly what corporate interests want. It keeps workers divided. It keeps politicians stuck. It keeps the broken system in place.

You’ve already broken through false binaries, Mr. President. You showed that Republicans can win working-class voters. You proved that supporting workers doesn’t mean opposing business. You demonstrated that the old political categories are obsolete.

The Workers’ REP Act continues that realignment.

This isn’t about unions vs. non-unions. It’s about:

  • Law-abiding businesses vs. law-breaking businesses
  • Workers who can exercise their rights vs. workers who live in fear
  • Enforcement that works vs. enforcement that’s a joke

The vast majority of American workers are NOT in unions. They never will be. But they have the same legal rights as union members—they just don’t know it, and they can’t use them.

The Workers’ REP Act protects ALL workers—union and non-union alike. It doesn’t force anyone to join a union. It doesn’t create new union power. It simply enforces the law that already exists for every American worker.

This is how we escape the trap: stop thinking in terms of union vs. non-union. Start thinking law enforcement vs. lawlessness.

You’re the law and order president, Mr. President. The Workers’ REP Act is law and order for the workplace. It says: If you break the law by retaliating against workers, you pay a real penalty.

That’s not pro-union or anti-union. That’s pro-law.

THE PROBLEM: WORKERS CAN’T USE THEIR RIGHTS

Mr. President, you know what it’s like to fight the system. American workers face the same rigged game every day.

Federal law gives 170 million workers the right to:

  • Discuss wages with coworkers
  • Organize to demand better conditions
  • Strike against unfair treatment
  • Act collectively to improve their workplace

But here’s the reality: Workers who exercise these rights get fired. And the system does nothing about it.

Current penalties for retaliation? Employers pay back wages minus what the worker earned elsewhere. That’s it. No real penalty. No deterrent. Just a cost of doing business.

Current timeline for justice? Years. The National Labor Relations Board takes years to resolve cases. By then, the worker has lost their home, their health insurance, and their ability to feed their family.

The result? Workers are terrified to exercise their legal rights. They silence themselves. The system succeeds through fear and intimidation.

This is the swamp you promised to drain. Corporate interests profit while workers suffer. The law exists on paper but means nothing in practice.

THE SOLUTION: WORKERS’ REP ACT

The Workers’ REP Act fixes this broken system with four simple principles:

1. RAPID ENFORCEMENT (DAYS, NOT YEARS)

  • 7-day hearings
  • 14-day decisions
  • 30-day final resolution
  • 90-day total timeline including appeals

Workers need justice fast. This delivers it.

2. MEANINGFUL DETERRENCE ($50,000+ PENALTIES)

  • Minimum $50,000 per violation
  • Escalating penalties for repeat offenders ($100K, $250K, $500K)
  • Personal liability for corporate officers
  • Criminal penalties for willful violations

Make retaliation expensive. Employers will think twice before breaking the law.

3. WORKER CONTROL (ANONYMOUS DOCUMENTATION)

  • Workers document violations anonymously through government system
  • Government-verified timestamps create indisputable records
  • Workers choose when to reveal their identity
  • Build comprehensive cases before taking action

Give workers the tools to fight back without risking everything upfront.

4. LEVERAGE EXISTING SYSTEMS (SAVE MONEY)

  • Use the IRS, Social Security, and CMS infrastructure
  • No massive new bureaucracy
  • Reduce implementation costs
  • Get it running faster

This is efficient government. Use what we have. Don’t build from scratch.

1. YOU CAMPAIGNED ON PROTECTING WORKERS

You won Pennsylvania, Michigan, Wisconsin, and Ohio—the Rust Belt—by promising to fight for workers. You said you’d bring back jobs, stand up to corporations, and put American workers first.

The Workers’ REP Act delivers on that promise.

It doesn’t matter if workers are union or non-union, Democrat or Republican, black or white. This protects all 170 million American workers.

This is how you prove you meant what you said.

2. THIS LEVELS THE PLAYING FIELD FOR AMERICAN BUSINESSES

You’re a businessman. You know that bad actors undercut honest competitors.

Right now, employers who follow the law face unfair competition from those who don’t. Companies that respect worker rights pay more. Companies that retaliate and intimidate pay less. The current system rewards cheaters.

The Workers’ REP Act creates a level playing field. All employers face the same rules. The same penalties. The same enforcement.

Good businesses benefit. Only bad actors lose.

3. THIS REDUCES GOVERNMENT BUREAUCRACY

You promised to cut government waste. The Workers’ REP Act does exactly that.

Instead of building a massive new agency, it:

  • Leverages existing federal infrastructure (IRS, Social Security, CMS)
  • Creates rapid enforcement (30 days vs. years)
  • Enables private attorney enforcement (market-based, not government-run)

You’ve already broken the traditional Republican mold. You’ve shown that the GOP can win working-class voters. The Workers’ REP Act cements that realignment.

  • You own the worker vote for generations
  • You prove the GOP is the party of working people

This is 4D chess, Mr. President. You outflank the Democrats on their own issue. You deliver for your base. You expand your coalition.

And you do it all while reducing government waste and helping American businesses compete fairly.

THE OPPOSITION WILL BE FIERCE

Corporate lobbyists will fight this. They’ll claim it’s too expensive, too burdensome, too radical.

Don’t believe them.

They’re protecting a system that lets them break the law with impunity. They’re defending their ability to retaliate against workers without consequences.

You’ve fought the establishment before. You’ve taken on the swamp. This is no different.
